1. About Donacelet

Donacelet is a product-based fundraising platform. Organizations such as schools, teams, clubs, charities, and community groups apply to run a fundraiser. Supporters purchase a physical NFC wristband or keychain, or a virtual support code, through that fundraiser's page, and each purchase unlocks a time-limited membership providing access to deals offered by third-party merchants. A percentage of each sale is paid out to the organization running the fundraiser. Organizations may also purchase units at wholesale for in-person resale under the wholesale program terms. By using our platform, you agree to these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, please do not use our services.

2. Your Account

To run a fundraiser, make a purchase, or access member deals, you'll need to create a free account. When you register, please provide accurate and current information. You're responsible for keeping your account credentials secure and for all activities that occur under your account.

3. Accessing Member Deals

Once you complete a qualifying purchase through a fundraiser, you'll unlock access to member-only offers from our merchant partners for the applicable membership period. These offers are provided directly by the merchants and are subject to their individual terms and conditions. Each merchant is responsible for fulfilling their own offers.

Tax Treatment: A Donacelet purchase is a purchase of a product and a membership, not a charitable donation, and it is generally not tax-deductible. Users are responsible for their own tax compliance and should consult a tax professional with questions.

4. Acceptable Use

Supporter accounts and memberships are for personal use. Organizations may run fundraisers on the platform and may resell wholesale units in person under the wholesale program terms. You agree not to misuse our platform by submitting false information or using the service for any unlawful purpose. You may not:

  • Modify, copy, or reverse engineer any part of our platform
  • Use automated systems to access or interact with our services
  • Remove copyright or proprietary notices
  • Violate any applicable laws or regulations

5. Service Disclaimer

Donacelet's platform is provided "as is" without warranties of any kind, either express or implied. We strive to maintain reliable fundraiser pages and seamless access to member deals, but we cannot guarantee uninterrupted service or error-free operation. Donacelet disclaims all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Limitation of Liability

To the fullest extent permitted by law, Donacelet and its partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

7. Changes to Terms

We may update these Terms of Service from time to time to reflect changes in our services or legal requirements. We'll notify you of significant changes by posting the updated terms on our website. Your continued use of Donacelet after changes are posted constitutes your acceptance of the revised terms.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Canada. Any disputes arising from these terms or your use of Donacelet will be subject to the exclusive jurisdiction of the courts located in Canada.
